Not to highjack your thread or anything; but I'm beginning to wonder why we copyright anything at all anymore. With the recent passage of the 2008 Orphan Act regarding copyrighted materials, it all but negates anything we might do to protect our works.

Listed below are two links that discuss and explain more about the act. The first one is from the US copyright office. The second is a discussion on RetouchPro.

Default valid point

You do have a valid point but as long as there are people that will put a cease and deist (sp?) on my works ie ford (the oval can not be used in a work of art) I will pursue a copyright. still would like to see if anybody can answer my question or point me to a place that can answer it.

Hi Theodore and Janet --

Theodore, I believe you can include a list of images with the zip file of the photographs that you are copyrighting -- sort of like a contact sheet. You do have to provide a way for the Copyright office to contact you when you file the application. If you include it, they can always ask you if they have questions.

Janet, the new Orphan Act is even more reason to register your images with the Copyright Office. Prior to the Orphan Act, the image belonged to the photographer who took it -- no copyright registration required. Now, if someone cannot find the photographer after a "deligent search", they can use the image. A deligent search of image data bases is one of the things "required" before someone can claim an "orphaned image" for their own use. If the image is registered with the US Copyright Office, it is pretty easy to find it and find it's rightful owner.
